Joe Biden fights for the rights of citizens: a ban on the use of spyware has been introduced

The US was the first country to introduce standards for the use of commercial spyware.

President Joe Biden signed an executive order yesterday banning federal agencies from using commercial spyware that may pose a threat to US security or has already been misused by foreign entities.

The order is aimed at addressing a growing number of cases of spyware abuse abroad, as well as against US officials, government systems, and ordinary citizens.

The White House noted that the use of spyware is not limited to authoritarian states – democratic governments have also been seen using commercial spyware “to track their own citizens without proper legal authorization and oversight.”

Biden’s order points to the abuse of spy technology, including attempts by foreign governments or individuals to access or spy on a U.S. citizen’s electronic device without legal permission.

The White House has identified 50 cases of espionage targeting US employees in at least 10 different countries, an administration official said.

The new directive also specifies the purposes of using the technology:

  • Intimidation of activists, dissidents or other actors;
  • Restraining dissent or political opposition;
  • Restrictions on freedom of expression, peaceful assembly or association;
  • Violation of human rights or suppression of civil liberties.

The directive also outlines steps commercial spyware vendors can take to avoid being accused of creating a potential risk to the safety of citizens. The steps include, for example, the cancellation of relevant license agreements or contracts.

However, the order does not require a list of organizations that violate the law, as each violation “needs to be determined on a case-by-case basis.” The order also does not require that the public be notified in the event of an incident.

The administration spokesman stressed that the order would create certain standards (which had not existed in the United States until now) regarding the identification and prohibition of commercial spyware. The directive will allow the US to “set an example” to other countries, the spokesman said.
