Texas Governor Greg Abbott signed bill , which prohibits children under 18 from registering on most social networks without parental permission. The law will go into effect in September 2024 and requires companies to obtain consent from a child’s parent or guardian before allowing them to create an account.

In addition, the law requires companies to prevent children from being exposed to “harmful” content related to eating disorders, substance abuse, or “seduction” of minors.

Some lawyers have already pointed out the vagueness of the term “digital service” in the law. Under the new law, children may need parental permission to visit almost any site that collects personally identifiable information. There are some exceptions to the law, such as websites that offer educational or news content and email services. The Texas Attorney General can sue companies that violate this law.

The law’s requirements to filter vaguely defined “harmful content” and give parents control over their children’s accounts are reminiscent of provisions in some federal laws that have raised concerns among rights groups.

Critics fear that content filtering could encourage companies like Instagram* or TikTok to over-moderate “harmless” content to avoid legal trouble. Overly strict parental control can also harm children in families where parents control children, allowing them to spy on marginalized children who are looking for useful resources on the Internet.

Louisiana passed a similar law on June 8, and several other states—Connecticut, Maryland, Minnesota, New Jersey, and Ohio—are considering similar bills.
